1000x Digital LLC respects the intellectual property of others and expects its customers to do the same. This policy explains how to tell us that material on a site we host infringes your copyright, how a customer can respond, and how we deal with repeat infringers. It applies to our own websites (micrositegenerator.com, websitebuilder.studio, 1000xdigital.com, leadgenerationconsulting.com, leadgenaisuite.com and www.micrositeonline.com), to our platforms at app.micrositegenerator.com and app.websitebuilder.studio, and to the sites our customers publish with our service, whether they appear on our hosting addresses (such as msgsites.net, msgsite.net or a websitebuilder.studio address) or on a customer's own domain.

We respond to notices that meet the requirements of the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.

1. HOW TO REPORT COPYRIGHT INFRINGEMENT

Send a written notice to our Copyright Agent (section 5). To be effective under the DMCA, your notice must include all of the following:
(a) your physical or electronic signature, as the copyright owner or a person authorized to act for the owner;
(b) identification of the copyrighted work you say has been infringed or, if several works are covered by one notice, a representative list of them;
(c) identification of the material you say is infringing, with enough information for us to find it — the full web address (URL)
of each page or file is best;
(d) your name, postal address, telephone number and email address;
(e) a statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent or the law; and
(f) a statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on the owner's behalf.

Before you send a notice, please consider whether the use could be a fair use or otherwise permitted by law. Under 17 U.S.C. § 512(f), a person who knowingly and materially misrepresents that material is infringing may be liable for damages, including costs and attorneys' fees. If you are not sure whether material infringes your rights, you may wish to consult a lawyer first.

A notice that does not substantially meet these requirements may not be acted on. Where a notice is incomplete, we may contact you to ask for the missing information.

2. WHAT WE DO WHEN WE RECEIVE A VALID NOTICE

- We act expeditiously to remove, or disable access to, the material identified. This may mean taking the affected page, file or site offline.
- We notify the customer responsible for the site promptly, and send them a copy of your notice, including your name and contact details as you gave them, so that they can respond. We send it to the customer by email; we do not publish notices.
- We record the notice against the customer's account for our repeat-infringer policy (section 4).
We do not decide copyright disputes between you and our customer. Our role is to follow the procedure the DMCA sets out.

3. COUNTER-NOTICE: IF YOUR MATERIAL WAS REMOVED BY MISTAKE

If you are our customer and you believe material was removed or disabled because of a mistake or misidentification, you may send a counter-notice to our Copyright Agent. To be effective, it must include all of the following:
(a) your physical or electronic signature;
(b) identification of the material that was removed or disabled, and where it appeared before it was removed or disabled;
(c) a statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification of the material; and
(d) your name, address and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which 1000x Digital LLC may be found), and that you will accept service of process from the person who sent the original notice, or that person's agent.

When we receive a valid counter-notice, we promptly send a copy to the person who sent the original notice and tell them that we will restore the material, or stop disabling access to it, in 10 business days. We then restore it not less than 10 and not more than 14 business days after we receive the counter-notice, unless our Copyright Agent first receives notice that the person who sent the original notice has filed a court action seeking to stop the customer from engaging in the infringing activity on our service.
A counter-notice, like a notice, may expose a person who knowingly and materially misrepresents the facts to liability under 17 U.S.C. § 512(f).

4. REPEAT INFRINGERS

We have adopted, and we enforce, a policy of terminating, in appropriate circumstances, the accounts of customers who are repeat infringers. We count a "strike" against an account for each valid notice about material on that account's sites, unless the notice is withdrawn, the material is restored after a valid counter-notice that is not followed by a court action, or we find that the notice was mistaken. An account that receives three strikes within any 12-month period will be terminated. We may also suspend or terminate an account sooner, including after a single notice, where the infringement is clear and deliberate. Termination under this policy follows our Terms of Service.
